Terms and Conditions

1. Definitions

  1. "CentralNic" means CentralNic USA Ltd, of 112 North Curry Street, Suite D, Carson City, Nevada 89703 USA.
  2. "Customer" or "You" means the person or entity requesting services as described below from CentralNic.
  3. "Email Service Provider" means the entity chosen by CentralNic to provide an email service complementary to CentralNic's own Email Identity Service. This is currently Microsoft Corporation, of One Microsoft Way, Redmond, Washington 98052 USA.

2. Email Identity Service Terms and Conditions

  1. You must have the right to use the email address, which will be issued by CentralNic. By applying to register the email address you warrant to us that you have that right.
  2. By applying to register the domain name you agree to indemnify and to keep CentralNic, and its officers, directors, shareholders, employees, agents representatives fully and effectively indemnified at all times against all costs, claims, liabilities, losses, damages, actions and expenses (including without limitation, legal expenses) arising directly or indirectly from the registration and/or any breach by you of any of these terms and conditions. This agreement to indemnify shall survive the termination of this Agreement.
  3. The initial period of registration of the email address may be up to a term of two calendar years. The registration may be further extended by additional years upon receipt of payment by CentralNic.
  4. You may surrender the registration of the email address at any time.
  5. Email addresses are registered on a first come, first served basis.
  6. Once the email address and your full details have been entered in the database no refund will be payable by CentralNic.
  7. Acceptance of applications to register the email address is at the sole discretion of CentralNic. Without prejudice to the generality of the foregoing, CentralNic may refuse to accept such application if the email address:
    1. is currently registered;
    2. is on the list of reserved words (this list is not available for public scrutiny);
    3. is obscene or otherwise deemed to be unsuitable by CentralNic in its sole discretion;
    4. is not permitted by the Email Service Provider.
  8. CentralNic may at its sole option, cancel the registration or suspend registration of the email address if:
    1. ordered to do so by a court of competent jurisdiction; and to comply with any applicable laws, government rules or requirements, requests of law enforcement or in compliance with any dispute resolution process;
    2. the use of the email address is illegal;
    3. if there is a breach of these terms and conditions, including without limitation, clause 1;
    4. the continued use of an email address could cause technical problems on the Internet, or the integrity or stability of the registry;
    5. at its sole discretion, CentralNic judges that the email address infringes the trademark or other intellectual property of a third party;
    6. if CentralNic believes that the email address was registered for use in a "phishing" attack or other illegal activity of any kind;
    7. if a request to cancel the registration is made by the Email Service Provider;
    8. if inaccurate or false contact details are provided.
  9. CentralNic shall not be liable to you, your assigns or successors or any person who is deemed to be a beneficary,whether in contract, tort, by statute or otherwise with respect of any general or special damages, loss of profits and/or for any special, indirect, incidental or consequential loss or damage arising out of or in connection with the email addresses registered hereunder, including without limitation:
    1. loss of revenue; and/or
    2. loss of anticipated savings; and/or
    3. loss of business and/or goods; and/or
    4. loss of goodwill; and/or
    5. loss of use; and/or
    6. loss and/or corruption of data and/or other information; and/or
    7. downtime; and/or
    8. any damage relating to the procurement of any substitute services.
    For the avoidance of doubt, neither the types of loss and/or damage specified in sub-clauses 1 to 9 inclusive of this clause nor any similar types of loss and/or damage shall constitute direct loss for the purposes of these terms and conditions.
  10. In no event shall CentralNic's liability to you whether in contract, tort, by statute or otherwise exceed the registration fee for the email address.
  11. Nothing in this Agreement shall exclude or restrict the liability of either party for fraudulent misrepresentation and/or for death or personal injury arising as a result of the negligence of that party, its officers, employees, agents and/or sub-contractors.
  12. CentralNic reserves the right to determine the provider of the Email Service. In the event that CentralNic chooses to change the Email Service Provider, CentralNic will make all reasonable efforts to provide you with opportunity and means to either transfer your email data (such as email messages and address books) to the new Email Service Provider, or to back up this data before the Email Service Provider is changed.
  13. You are solely responsible for all activity when using your email address in conjunction with the Email Service Provider.
  14. If CentralNic changes the terms of this Agreement, then CentralNic will notify all Customers at least 30 days before the changes are effected. Notification shall be deemed effective when made via email or by posting a notice on the CentralNic Website. If you do not agree to the changes, then you must cancel the Service before the 30-day period expires. If you do not stop using the service, then your use of the service will continue under the changed contract.
  15. The Service is provided "as-is" and without any warranties, express or implied, or guarantees.
